GOVERNING LAW AND VENUE
These Terms and any dispute arising out of your relationship with the Company shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles. You explicitly agree that any legal action, litigation, or dispute resolution must be filed exclusively in the state or federal courts located in Knox County, Tennessee.
NATURAL MEDIUM AND ARTWORK DISCLAIMER
Wood is a living, organic material, and pyrography is a handmade art form. By purchasing our Products, you acknowledge and agree to the following natural characteristics, which do not constitute defects:

Wood Variation: Natural wood features unique variations in grain patterns, knots, burls, color, and texture. No two pieces are identical.

Environmental Movement: Wood naturally expands, contracts, wraps, or develops minor seasonal checking (hairline cracks) in response to changes in temperature and humidity. Indoor climate control is required to minimize this movement.

Pyrography Artifacts: Hand-burned artwork will feature slight variations in burn depth, shading, and texture. Over time, natural wood and wood burning may shift in color or fade if exposed to direct sunlight or harsh UV rays.
WARRANTY DISCLAIMER ("AS IS" SALE)
TO THE FULLEST EXTENT PERMITTED BY TENNESSEE LAW, ALL PRODUCTS ARE SOLD ON AN "AS IS" AND "AS AVAILABLE" BASIS. COMPANY EXPLICITLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE RISK OF PRODUCT BEHAVIOR DUE TO NATURAL MATERIAL AGING OR IMPROPER ENVIRONMENT COMPLIANCE RESTS SOLELY WITH THE BUYER.
CUSTOM COMMISSIONS AND BUILDS
The following rules apply specifically to custom woodworking, custom wood burning, or personalized items:

Deposits: A non-refundable 50% deposit is required before material sourcing or fabrication begins. If you cancel the order after work has started, this deposit is permanently forfeited to cover labor and materials.

Design Approval: You must provide written approval (email or digital signature) for final technical layouts, dimensions, wood species, and pyrography design proofs. The Company is not responsible for dimension or design errors in a concept that you formally approved.

Modification Window: You have a strict 24-hour window following design approval to request changes. After 24 hours, the design is locked, and any subsequent changes will incur additional material and labor fees.

Final Balance: The remaining 50% balance must be paid in full upon product completion and prior to delivery, shipping, or local pickup.
E-COMMERCE AND PRE-MADE PRODUCTS
The following rules apply to standard, pre-made items purchased directly through our website checkout:

Payment: Orders must be paid in full (100%) at the time of electronic checkout.

Inventory Availability: We reserve the right to cancel any online order and issue a full refund if an item listed online concurrently sells out in person or displays an incorrect price due to a system error.

Cancellations: You may cancel an online inventory order only if a shipping label has not yet been generated. Once shipped, the standard return policy applies.
RETURNS, REFUNDS, AND CANCELLATIONS

Custom & Personalized Items: Strictly no returns, exchanges, or refunds are permitted on custom commissions, engraved items, or personalized pyrography pieces due to buyer's remorse or structural shifts caused by poor climate control.

Stock Inventory: Unaltered, pre-made inventory items may be returned within 14 days of delivery. The item must be completely unused and shipped back in its original packaging.

Return Costs: The buyer is entirely responsible for return shipping and freight costs. All eligible returns are subject to a 15% restocking fee, which will be deducted from your final refund.
SHIPPING, DELIVERY, AND RISK OF LOSS

Lead Times: All completion dates, production timelines, and shipping schedules provided by the Company are strictly estimates. We are not liable for delays caused by lumber shortages, dry times, curing processes, or third-party transit delays.

Transfer of Risk: For shipped items, Risk of Loss transfers to the buyer the moment the product is safely loaded onto the third-party shipping or freight carrier's vehicle at our workshop.

Freight Inspection Mandatory: For large freight deliveries, you must inspect the pallet and product for damage before signing the delivery receipt. Signing the receipt without documenting damages explicitly waives your right to carrier insurance claims and releases the Company from liability for shipping damages.
STORAGE AND ABANDONED PROPERTY

If a custom product is completed and final payment is processed, you must arrange for pickup or delivery within 14 calendar days.

On the 15th day, a $20.00 daily storage fee will accumulate.

If a product remains uncollected or delivery is refused for more than 60 calendar days, the item will be legally deemed abandoned under Tennessee law. The Company reserves the right to retain all payments made and sell the item to recover storage and maintenance costs.
INTELLECTUAL PROPERTY
All custom designs, sketches, digital mockups, pyrography artwork patterns, photographs, logos, and textual content displayed on this Site or provided during consultation remain the exclusive intellectual property of C and C Woodworking & Pyrography LLC. You may not copy, replicate, or commercially exploit our furniture, custom designs or artwork without express written consent.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, C and C Woodworking & Pyrography LLC shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our products, including but not limited to injuries resulting from improper furniture anchoring, modification, or product maintenance. Our total liability shall not exceed the total amount paid by you for the specific product in question.
